Short Sales and foreclosures have very different protections as well as benefits. It is imperative as a homeowner to know the difference between the two and why they can both be the potentially wrong choice. Their are more options available to you than you might think. Keep in mind that a loan modification may seem like a good option but also may be the wrong option depending on what you long term game plan is. Loan modifications are only useful if you are planning on staying in the home for a long  period of time. Most people want to try to do a loan modification because they like the idea of reducing their principal (which almost never happens) and they miss the fact that they are having to miss payments while they are trying for the loan modification. A deed-in -lieu is another option that may be work for your situation, but in most cases the bank will require you to try a short sale first in order to qualify for the program. In some instances, the bank can slip in terms of the deed-in-lieu that actually take away your deficiency protection that you would have had if you would have just walked away from you home. Another common alternative is a short sale. In most cases you will receive a full deficiency waiver for any balance remaining on your home. This will allow you to sell your home, even if you are upside down, and it wont cost you any real estate fees. In some cases we have even been able to get money for the homeowner for their moving expenses. For most homeowners, doing a short sale is the best option (but not always).
